Terms of Service / EULA
These terms apply to the BebiWhy iOS app (shown as “宝宝怎么了” when Simplified Chinese is selected), provided by Sichuan Parabola Technology Co., Ltd. (“Company,” “we,” “us,” or “our”). By downloading or using the app, you agree to these terms. If you do not agree, do not use the app.
1. License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use BebiWhy on Apple-branded devices that you own or control, subject to these terms and Apple’s usage rules. Apple’s Standard Licensed Application End User License Agreement also applies and controls if it conflicts with these supplemental terms.
2. Purpose and Important Limits
BebiWhy is a parenting observation and record-keeping aid. It uses a caregiver-started 10-second camera session to provide general, informational reference cues and lets the caregiver keep local videos, notes, and PDFs.
- The app does not replace a caregiver’s judgment, a qualified professional, or emergency services.
- Reference cues may be incomplete, unavailable, or incorrect because of lighting, movement, camera position, device conditions, or other factors.
- The live-person and smile cues are convenience features only. They may make mistakes and do not establish anyone’s identity.
- If you are concerned about a child or believe urgent help may be needed, stop using the app and promptly contact a qualified professional or local emergency services.
3. Caregiver Responsibilities
You must be legally able to agree to these terms. You are responsible for supervising use of the app, obtaining any permission required before recording another person, protecting a child’s privacy, safeguarding your device, reviewing information before sharing it, and following applicable laws.
4. Local Data and User-Initiated Sharing
BebiWhy has no account, subscription, advertising, or cloud synchronization. App content is stored locally. You are responsible for backups and for copies you choose to share or save outside the app. Deleting the app removes its local container and we cannot recover it. See the Privacy Policy for details.
5. Acceptable Use
You may not misuse the app, attempt to bypass its security, interfere with its operation, violate another person’s privacy or rights, use it unlawfully, or copy, resell, or redistribute it except where applicable law expressly permits.
6. Ownership and Third-Party Components
The app and its original content remain the property of the Company and its licensors. Open-source and third-party components remain subject to their respective license terms. Apple is not responsible for providing maintenance or support for the app except as required by applicable law or Apple’s standard agreement.
7. Availability and Warranty Disclaimer
To the maximum extent permitted by law, BebiWhy is provided “as is” and “as available,” without warranties of accuracy, uninterrupted availability, or fitness for a particular purpose. We may change, suspend, or discontinue features where reasonably necessary.
8. Limitation of Liability
To the maximum extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, inability to use, or reliance on the app. Nothing in these terms excludes liability that cannot lawfully be excluded.
9. Governing Law and Changes
These terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles, except where the law of your place of residence requires otherwise. We may update these terms when the app changes. The date at the top identifies the current version.
